Privacy Policy

Backlit LLC (“Backlit,” “we,” or “us”) provides a platform for participants (“Participants”) to apply and audition for events, productions, and work opportunities, and for administrators (“Admins”) to manage events, productions, and workforces. This privacy policy (the “Privacy Policy”) explains how we collect, use, disclose, and protect information in connection with our web sites (the “Sites”), services, any Backlit mobile services and applications, and any software provided on or in connection with the Backlit services (collectively, the “Services”), and explains your choices about your information. Capitalized terms that are not defined in this Privacy Policy have the meanings given in our Terms of Service. By using the Services, you acknowledge this Privacy Policy and agree to the collection, use, storage, and disclosure of your information as described in it and in our Terms of Service.
Backlit may provide portions of the Services, and may employ Participants who are selected for opportunities, through its affiliates, including Backlit People LLC. Where you are hired for an opportunity through a Backlit affiliate, this Privacy Policy describes how employment-related information is handled on the platform, and your employment documents and applicable law also apply to your employment records.

INFORMATION WE COLLECT
- Information you provide to us directly: When you create an account or profile, apply or audition, or communicate through the Services, we collect the information you choose to provide, such as your full name, photos, videos, audition materials, biography, sizing and role-relevant details requested for an opportunity, birthdate, phone number, email address, and mailing address. We also retain the contents of messages you send to us, to other Users, or through the Services, and information contained in User Content you post or upload.
- Employment and onboarding information: If you are selected for an opportunity and employed or engaged through Backlit or its affiliates, we collect additional information needed to employ and pay you and to comply with law, which may include government identification numbers (such as your Social Security number) and identity documents for employment eligibility verification, tax withholding elections, payroll and direct deposit details, emergency contact information, work authorization information, time and attendance records, credentialing information required by venues or productions, and, where required for an opportunity and conducted under separate disclosures and authorizations, screening and background check results. Workers’ compensation and workplace incident information is collected and handled where required in connection with your employment.
- Information we receive from third parties: We may receive information about you from third parties, such as: (i) third-party log-in services you choose to connect (which may pass us your user ID, an access token, and information you have permitted the service to share); (ii) consumer reporting agencies and screening vendors, where a background check is required for an opportunity and you have provided the separate authorization required by law; and (iii) Admins, productions, venues, and credentialing bodies in connection with opportunities you pursue (for example, selection decisions and credentialing outcomes). Always review your privacy settings on third-party services before connecting them to the Services.
- Biometric information: We do not currently collect biometric identifiers or biometric information (such as faceprints, fingerprints, or voiceprints), and photos and videos you provide are not used to create biometric identifiers. If we introduce features that use biometric information in the future (for example, biometric event check-in), we will update this Privacy Policy first, provide clear notice, obtain any consent required by applicable law (including written consent where required) before collecting biometric information from you, and publish a retention and destruction schedule for it. Any such feature will be optional wherever the law or the nature of the engagement permits.
- Information collected automatically: When you use the Services, we and our service providers automatically collect: (i) analytics information about traffic and usage; (ii) cookies information (see Section IV); (iii) log file information such as your IP address, browser type, referring/exit pages, and how you interact with the Services; (iv) device identifiers for the devices you use; and (v) location information — approximate location inferred from your IP address and, only if you grant permission through your device settings, precise location used for event and check-in features. You can withdraw device-level permissions (such as location) at any time in your device settings; some features may not function without them.

HOW WE USE INFORMATION
We use the information we collect to: provide, operate, personalize, and improve the Services; create and administer your account and profile; deliver your applications and audition materials to the Admins and productions you apply to; communicate with you about your account, applications, opportunities, schedules, and assignments (including by email, text message, and push notification, as described in our Terms of Service); where you are employed or engaged through Backlit or its affiliates, onboard, employ, schedule, and pay you, administer workers’ compensation and benefits, and satisfy tax, employment, and safety compliance obligations; verify identity, authenticate Users, and prevent fraud and abuse; conduct screening where required for an opportunity and authorized by you; analyze usage and improve the Services; provide support and troubleshoot problems; enforce our Terms of Service and protect the rights, property, and safety of Backlit, our Users, and others; and comply with law. We may also send you newsletters and information about opportunities and features we believe may interest you; you can opt out of those messages at any time, though you may not opt out of essential Service-related and employment-related notices.

HOW WE SHARE INFORMATION
- We do not sell your information: We do not sell your Personally Identifiable Information, and we do not share it with third parties for cross-context behavioral advertising.
- Admins and productions: When you apply or audition for an opportunity, you direct us to share your profile, application, and audition materials with the Admins and associated representatives of that opportunity for evaluation, casting, and production purposes. Where you are employed on an opportunity, we share with the applicable production and venue only the information reasonably necessary for the engagement — such as rosters, schedules, and credentialing data — consistent with our agreements with them. Admins, productions, and venues are independent parties, and their use of information is governed by their own policies and their agreements with Backlit.
- Service providers: We share information with vendors that perform services on our behalf and are bound to appropriate confidentiality and data protection obligations, including hosting and infrastructure providers, communications providers (email, SMS, and push delivery), payroll and payment processing providers, benefits and insurance administrators (including workers’ compensation carriers), screening and background check vendors (where authorized), electronic signature and document providers, and analytics providers.
- Affiliates: We share information within the Backlit family of companies, including Backlit People LLC, for the purposes described in this Privacy Policy, including to employ and pay Participants selected for opportunities.
- Public content: If you post something in a public area of the Services, any information or content you voluntarily disclose becomes available to the public as controlled by applicable privacy settings. If you remove information you posted, copies may remain in cached or archived pages, or with Users who copied or saved it.
- Corporate transactions: We may buy, sell, or divest the company or any combination of its products, services, assets, or businesses. Information, including Personally Identifiable Information and User Content, may be among the items transferred in these types of transactions, and may also be transferred in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, or similar transactions or proceedings, provided that the recipient will continue to be bound by the terms of this Privacy Policy with respect to the transferred information.
- Legal requirements and protection: We will disclose information where required to do so by law, subpoena, or legal process, or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement or other authorities (including tax, employment, and safety authorities in connection with employment through Backlit or its affiliates); (b) enforce our Terms of Service or protect the security or integrity of our Services; and/or (c) exercise or protect the rights, property, or personal safety of Backlit, our Users, or others.
- Aggregated and de-identified data: We may aggregate or de-identify data so that it no longer reasonably identifies you and use or share that data for any lawful purpose, and we will not attempt to re-identify it except as permitted by law.

COOKIES, ANALYTICS, AND PREFERENCE SIGNALS
We and our service providers use cookies, log files, device identifiers, and similar technologies to remember your information, keep you signed in, provide and personalize the Services, measure traffic and usage, diagnose and fix problems, and keep the Services secure. A persistent cookie remains on your device after you close your browser and can be removed by following your browser’s directions; a session cookie disappears after you close your browser. You can set your browser to refuse cookies or to indicate when a cookie is being sent, though some features of the Services may not function properly with cookies disabled. Where required by applicable law, we honor opt-out preference signals such as the Global Privacy Control.

TEXT MESSAGES AND COMMUNICATIONS DATA
When you opt in to text messaging (SMS, MMS, and RCS rich messaging) as described in our Terms of Service, we collect and use your mobile number, your opt-in and opt-out status, message delivery and read-status information (including RCS delivery and read receipts), and your responses to interactive message features (such as suggested replies) to send and manage those messages and act on your responses. Text messaging originator opt-in data and consent will not be shared with, or sold to, any third parties for any purpose; our communications service providers process messages solely on our behalf and under our instructions in order to deliver the messages you have requested. Reply STOP to cancel text messages at any time.

HOW WE STORE AND PROTECT INFORMATION
- Storage and processing: Information collected through the Services may be stored and processed in the United States or any other country in which Backlit or its affiliates or service providers maintain facilities. If you access the Services from outside the United States — including as a participant in an opportunity located in Canada or another country — you understand that your information will be transferred to and processed in the United States and other jurisdictions that may not have the same data protection laws as your jurisdiction, and we take steps designed to ensure it remains protected consistent with this Privacy Policy and applicable law.
- Keeping your information safe: Backlit cares about the security of your information and uses commercially reasonable administrative, technical, and physical safeguards designed to preserve the integrity and security of information collected through the Services, including limiting access to employment and payroll information to personnel who need it. However, no security measures are perfect, and Backlit cannot ensure or warrant the security of any information you transmit to us. Backlit is not responsible for the functionality or security measures of any third party.
- Compromise of information: In the event that information under our control is compromised as a result of a breach of security, Backlit will take reasonable steps to investigate the situation and, where appropriate, notify the individuals whose information may have been compromised and take other steps in accordance with applicable laws and regulations.

RETENTION
We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, considering the nature of the information, the purposes for which it is collected, and our legal and contractual obligations. Profile and application information is retained while your account is active and for a reasonable period thereafter so that you can apply to future opportunities without rebuilding your profile. Employment, payroll, tax, workers’ compensation, safety, and screening records relating to employment through Backlit or its affiliates are retained for the periods required by applicable law, even if you delete your account. Information may also persist for limited periods in routine backups and where retention is required to comply with law, resolve disputes, or enforce agreements.

YOUR CHOICES ABOUT YOUR INFORMATION
- Access, correction, and deletion: You can review and update your account and profile information through the Services. You can request access to, correction of, or deletion of your information, or a copy of your account data, through the features of the Services or by emailing help@getbacklit.com. We will act on verified requests within the time required by applicable law. Deleting your account removes your access to your profile and account information through the Services; it does not delete records we are required or permitted by law to retain, including the employment-related records described in Section VII, which we continue to protect in accordance with this Privacy Policy.
- Communications choices: You can opt out of promotional emails using the unsubscribe option in those messages, opt out of text messages by replying STOP, and manage push notifications in your device settings. You may not opt out of essential notices about your account, your applications, or your employment.
- Declining to provide information: You may decline to submit information through the Services, in which case Backlit may not be able to provide certain Services or consider you for certain opportunities.
- Device permissions and tracking tools: Refer to your device or browser settings for instructions on how to delete or disable cookies, device identifiers, and location access. Disabling them may limit features of the Services.

U.S. STATE PRIVACY RIGHTS
Residents of California and other U.S. states with comprehensive privacy laws (including, as applicable, Utah, Colorado, Connecticut, Virginia, Texas, and Oregon) may have some or all of the following rights with respect to personal information covered by those laws: the right to know and access the personal information we have collected about you, including the categories of information, sources, purposes, and categories of third parties to whom it is disclosed; the right to correct inaccurate personal information; the right to delete personal information, subject to legal exceptions (including exceptions for employment, payroll, tax, and safety records we must retain); the right to opt out of the sale or sharing of personal information and of targeted advertising (as described above, we do not sell personal information or share it for cross-context behavioral advertising); the right to limit certain uses of sensitive personal information (we use sensitive personal information, such as government identifiers and precise location, only for the purposes permitted without a right to limit, such as providing the Services you request, employment administration, security, and legal compliance); and the right not to receive discriminatory treatment for exercising your rights. Please note that some state privacy laws do not apply to information collected in an employment context; where they do not, we nonetheless handle that information as described in this Privacy Policy.
You may exercise these rights by emailing help@getbacklit.com or through the features of the Services. We will verify your request using information associated with your account, and you may designate an authorized agent to make a request on your behalf where permitted by law. California residents may also request, once a year and free of charge, information about any Personally Identifiable Information disclosed to third parties for their direct marketing purposes in the preceding calendar year (California Civil Code § 1798.83); as described above, we do not disclose Personally Identifiable Information to third parties for their direct marketing purposes.

CHILDREN’S PRIVACY
Backlit does not knowingly collect or solicit Personally Identifiable Information from anyone under the age of 13 or knowingly allow such persons to register as Users, and the Services are not directed at children under 13. IF YOU ARE UNDER 13, please do not send any information about yourself to us. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information as quickly as possible; if you believe we might have information from or about a child under 13, please contact us at help@getbacklit.com. For productions that permit minor participants, a profile for a Participant under 18 may be created and managed only by a parent or legal guardian acting as the Participant’s Representative under our Terms of Service, and information about minor Participants is collected from and managed by the parent or guardian.

OTHER WEB SITES AND SERVICES
We are not responsible for the practices employed by websites or services linked to or from the Services, including the information or content contained therein. When you use a link to go from the Services to another website, this Privacy Policy does not apply to that third-party website or service; your browsing and interaction there are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible for and do not control any third parties that you authorize to access your User Content. If you allow a third-party service access to your User Content, you do so at your own risk. This Privacy Policy does not apply to information we collect by other means (including offline) or from sources other than through the Services, except as expressly stated for employment records handled in connection with the Services.

CHANGES TO OUR PRIVACY POLICY
Backlit may, in its sole discretion, modify or update this Privacy Policy from time to time, and so you should review this page periodically. When we change the policy in a material manner, we will update the “last updated” date at the top of this page and take reasonable steps to notify you, such as by email or notice through the Services.
